He's the fellow in upstate New York who sued last July, claiming that, way back in 2003, Zuckerberg had agreed to give him a 50% ownership in the project that became Facebook.

That claim seemed preposterous at the time, not least because Ceglia had waited 7 years to file it.

And there was also the fact that Ceglia was a convicted felon, having been charged with criminal fraud in connection with a wood-pellet company he operated.

In the weeks following the filing of the lawsuit, Ceglia produced what Ceglia said was a copy of the contract he and Mark Zuckerberg had signed covering two projects on which the two were working together--a Ceglia project called "StreetFax" and a Zuckerberg project called "the face book." He also produced a canceled check for $1,000. He also explained why he waited 7 years to file the claim.

The purported contract (we analyzed it here) gave Ceglia a 50% ownership in "the face book" project in exchange for funding its initial development, as well as an additional 1% ownership of the project per day for every day that the project remained uncompleted past a certain launch date.

When the lawsuit and the purported contract came to light, Facebook dismissed the whole thing as a fabrication.

Specifically, Facebook said the StreetFax part of the contract was real but that the rest had been doctored to include mention of "the face book."

And given the time that had passed, Ceglia's fraud conviction, and the lack of a payment trail for payments made to fund the development of "the face book" (as opposed to StreetFax), this indeed seemed the most logical explanation.

But now Paul Ceglia has refiled his lawsuit. With a much larger law firm. And a lot more evidence.

And the new evidence is startling.

THE EMAILS

Ceglia has produced more than a dozen of what he says are emails between him and Mark Zuckerberg from July 2003 to July 2004, the year in which Facebook was created.

In these purported emails, which we have included below, Zuckerberg and Ceglia discuss "the face book" project in detail. They discuss how Ceglia will fund the project. They discuss how Ceglia has funded the project (proof of payment). They discuss how Zuckerberg has met some upperclassmen--the Winklevosses, presumably--who are pursuing a similar project, and how Zuckerberg is "stalling" them. They discuss how Zuckerberg has failed to complete the "face book" project on time. They discuss the launch of the face book, which Ceglia agrees looks great.

The emails then include Zuckerberg telling Ceglia that the Facebook site is not doing well. They include Zuckerberg telling Ceglia that the site has seen so little success that Zuckerberg is thinking of shutting it down. And, in the summer of 2004, they include Zuckerberg offering to send Ceglia his $2,000 of funding back--right at the time Zuckerberg had moved to California to continue to develop, incorporate, and raise money for Facebook.

Ceglia contends that most of what Zuckerberg told him after the launch of the site were lies. (Facebook, as we all now know, went gangbusters right from the beginning).  And Ceglia contends that, in the summer of 2004, Zuckerberg "misappropriated" the assets of their general partnership and conveyed them to the corporation that became Facebook, Inc.

Lastly, Ceglia contends that, in accordance with the original agreement, he was entitled to an equal share of Zuckerberg's ownership in the corporation.

FACEBOOK'S RESPONSE

We've talked to Facebook about the new evidence, which we'll run through in detail in the following pages. Facebook says the new emails, like the contract, are fake.  In a statement to us, Facebook lambasted Ceglia as a "scam artist" and a "convicted felon." 

We asked Facebook how it is certain the emails are fake.  (After all, how would Facebook know for sure?)

Facebook would not elaborate except to say that it is "confident in [its] assessment."

Facebook almost certainly has a forensic analysis of Mark Zuckerberg's hard drives and email boxes from this period, because these drives would have been the same ones analyzed in the Winklevoss lawsuit. Perhaps the drives show different versions of the emails in question--or no emails at all.

But it's not clear that even a forensic analysis would contain records of emails that had been deleted at the time--and given the way his partnership with Ceglia appears to have ended, Mark Zuckerberg might well have deleted them. In which case, Facebook's confidence about the emails being "fake" would have to be based solely on Mark Zuckerberg's recollection.

CEGLIA'S NEW LAW FIRM

Paul Ceglia's new law firm is a bit more powerful than the small-town upstate New York lawyer who was representing him last summer. The firm is DLA Piper, which is a major international law firm that primarily represents technology companies. 

We have spoken to DLA Piper about the new evidence and amended lawsuit.

DLA Piper took on Ceglia's case very recently, after performing "weeks" of due diligence to persuade itself that Ceglia's claims were valid.

As part of its due diligence process, DLA Piper says, it performed an electronic analysis of the contract Ceglia provided. The firm says this analysis made it confident the contract has not been doctored.

DLA Piper says the lawsuit is well within the statute of limitations in New York, which is 6 years from the breach of contract. DLA regards the "breach of contract" as Mark Zuckerberg's incorporating Facebook in July 2004 and conveying the assets of the Ceglia-Zuckerberg partnership into the new corporation without telling Ceglia. The lawsuit, meanwhile, was filed in early summer 2010.

THE BOTTOM LINE

And what do we think, having looked at this new batch of evidence?

We think that, if the emails and contract Ceglia produced are indeed fake, the fraud should be easy to expose (so easy, in fact, that we imagine DLA Piper's investigators would already have exposed it--which leads us to question whether the emails and contract really are fake). We also think that, if the emails are fake, Paul Ceglia will be going to jail for a long, long time--a consequence that we assume was not lost on him. It's one thing to allegedly defraud a few local customers by selling them wood pellets that you then don't deliver. It's another to try to defraud a major corporation out of hundreds of millions of dollars (or more).

Meanwhile, we think that if the Ceglia emails and contract are NOT demonstrably fake, Facebook will soon be paying Paul Ceglia several hundred million dollars--if not billions--in a settlement.

We think Paul Ceglia still has some major questions to answer, the most notable of which is why he waited so long to file his claim. (Last summer, Ceglia explained that he forgot about the contract, which is not particularly persuasive in light of the huge publicity Facebook and Mark Zuckerberg eventually received. Ceglia also said he only stumbled across the contract, ironically, when he was going through his files in connection with the fraud charges for his wood-pellet company).

Based on other emails, instant messages, and behavior of Mark Zuckerberg in the fall and winter of his sophomore year at Harvard, we also think that the duplicitous Zuckerberg behavior that Ceglia describes is plausible.

Lastly, we note that Ceglia's emails do not make Ceglia sound like a prince among men, either. So if Ceglia fabricated all of these emails, he was smart enough to add verisimilitude to his tale by making himself look like a bit of a jerk.

In short, to us at least, the emails don't read "fake."

One of the most complex aspects of desktop virtualisation is working out what to do with all the users' data. Sizing and planning storage infrastructures to support hundreds or thousands of remotely-hosted desktops is a daunting prospect, especially to those who have relied heavily on local PC hard drives in the past. What is the best approach?

"Thirty-five to 40 per cent of the cost of VDI lies in enterprise storage," estimates Andy Goddard, practice leader at Computacenter. "When you have to provide a lot of VDI for lots of users, it ramps up quickly. An average Windows user might have 10Gb of space." But there are ways to get the costs down.

Understanding where to store virtual machine data is the first challenge. "Typically you'll store it on a storage area network (SAN), and then share the virtual machine data out," says Joe Mayhew, CTO at Calyx, a managed services provider.

The speed of SAN

Getting the data to and from the SAN to the server quickly enough can be a challenging task. Servers need low-latency data access for performance purposes. Typically, SANs have connected to servers using the specialist high-speed Fibre Channel storage networking protocol.

However, Fibre Channel is typically a higher-cost system, and depending on the type of applications that you're running, the performance gain may not always warrant the cost. In addition to the extra capital expenditure, it requires more specialist management skills, which can bump up your operational costs too.

ISCSI is an alternative SAN connectivity protocol, which unlike original Fibre Channel uses Ethernet as a transport layer. It is typically cheaper than Fibre Channel, and with 10Gbit Ethernet connections now available, it can offer relatively high performance. That said, there are downsides. In particular, iSCSI is a lossy protocol although this can be mitigated somewhat by putting it on a separate network segment.

The alternative is Fibre Channel over Ethernet, although this requires an upgrade to Converged Enhanced Ethernet (CEE) to provide the lossless transport layer that Fibre Channel requires.

"There are vendors doing hybrids - Brocade does FCoE and iSCSI," says Mayhew. "You plug it all into the same switch, so that you have converged network adaptors that talk both protocols." These hybrid systems are still fairly new, though.

Storage networking isn't the only place where system designers need to think smarter; the storage devices themselves must be designed to reduce costs. Organisations will want to balance performance and price.

So Solid Crew

At the high-performance end, some solid-state storage can boost performance in critical areas. One approach is to store user data on lower-cost hard drives, while storing virtual machines themselves on solid state drives that offer higher performance.

Much of the smarts come with good software. A storage resource management package is crucial if you are to make the best use of your storage infrastructure. This will effectively manage the allocation of disk space in a virtualised storage system, and generally carries a number of benefits (depending on the package you choose). For example, automated storage tiering can help to minimise the capital outlay on hard drives, too.

Administrators can use automated tiering to put 'disposable' and file swap data on cheaper, slower disks. David Chalmers, CTO of HP, recommends simplifying automated rules for tiering. "Having that automated, rather than having storage analysts moving it around, is where you get a big benefit," he says. The simplest rule focuses on time; if a file is accessed infrequently enough, then it trickles down from a set of SAS drives to SATA storage instead, for example.

Envisioning provisioning

It also pays to consider deduplication, says Calyx's Mayhew. Storage resource management software now frequently includes deduplication capabilities that will strip out duplicate data, sometimes at byte level, to minimise storage impact. What other measures can be taken to reduce storage overhead?

The way that desktops are provisioned can have a significant effect, says David Angwin, European marketing director at Wyse. "You're not picking up someone's whole environment and dropping it into the data centre as-is", he says. Instead, desktop images will be drawn from a pool, and the user profile will be built on the fly using streamed applications.

Ultimately, effective storage in a virtualised desktop architecture involves a mixture of hardware and software expertise.

Choosing the right devices and the right networking equipment for the job will give you a foundation for optimal performance, but without proper storage management, you could still see costs skyrocketing.

The key here is automation, so that administrators already tasked with learning new ways to manage a virtualised desktop environment aren't overtaxed by the huge pools of data that they suddenly find under their control. ®

Knowledge management finally is getting smart.

A decade ago, you could hardly open a trade magazine or attend a conference without getting bludgeoned by the idea of knowledge management. But KM applications were expensive and clunky. For the most part, workers had to enter data in unintuitive ways and ROI was dicey.

Over the years, these applications have improved, while SharePoint and other tools have made collaboration easier. But KM remains tricky because there's no template for collecting data and information and transforming it into knowledge. Although monolithic KM applications aren't going away--and many are adapting to today's changing workscape--the reality is that the definition of KM is changing.

Social networks can serve as a powerful form of knowledge management--especially if there's a way to capture and share postings. In fact, for some companies, these networks are more useful than any commercial collaboration or KM package. People share market intelligence, sales leads, travel tips, you name it. Free of imposed structure and artificial rules, they're able to function how humans function best: informally.

What's fascinating about the current environment is that smartphones are increasingly the underpinning of social interaction and KM. In fact, they're turning the entire process upside down. For example, an iPhone app like DocScanner serves as nothing less than a pocket document management system. You snap an image of a magazine article or a brochure and it converts the file to a PDF or text using OCR. Evernote or Dropbox, both linked to the app, make sharing the information with others only a tap away.

Other smartphone apps make it ridiculously easy to share audio, video and sundry other forms of data, information and knowledge. While all this might seem somewhat unruly and unsettling, it's important to recognize that order can come from chaos, and knowledge can come from seemingly random scraps of information. In fact ad hoc and informal systems that let users define the rules and connect their own dots redefine and transform KM.

The possibilities are limited only by creativity and an IT organization's willingness to facilitate sharing. Let real KM begin.

Like every other Apple fan boy out there, Maine’s Auburn County School District agrees that the iPad is truly wonderful. That’s why they’ve bought every Kindergartener a brand new, shiny iPad 2 for academical purposes. Man, it would be awesome to be five again – of of course to live in Auburn County, Maine.

Apparently, according to school Superintendent, Tom Morrill, the overhaul will cost the system about $200,000 this coming fall when each of the expected students gets their hands on the powerful, $500 Apple machine. The iPads will aid the students with basic educational purposes – alphabet, numbers, etc. They will be able to take the iPads home after school.

Seems Maine is a pretty Apple savvy state, considering that they also equipped each Middle Schooler with MacBooks starting in 2009. No need to say how crazy, yet awesome that is for the students on the receiving end!

, , We've heard plenty of stories over the past few years about tagging animals with RFID chips, but we've never been particularly keen on the idea. Well, now a team of researchers has come up with a much less invasive way of tracking individual animals -- specifically zebras -- by essentially using their stripes as barcodes. StripeSpotter, as it's known, takes an isolated portion of a photograph of a zebra and slices it into a series of horizontal bands. Each pixel in the selection is then fully converted into black or white, and the bands are in turn encoded into StripeStrings, which eventually make up a StripeCode that resembles a barcode. All this information is stored in a database that allows researchers to directly identify particular animals without ever having to get too close. StripeCode may be a zebra-centric application for now, but its developers see it making a mark across the food chain with the inclusion of other distinctly patterned beasts, like tigers and giraffes. What Technology Wants: Kevin Kelly's Theory of Evolution for Technology

Over the past week I read Kevin Kelly's latest book, What Technology Wants. It's a highly ambitious and expansive book, which looks at technology from an evolutionary perspective. Over 350 pages, Kelly outlines and explores technology as a living system, akin to humanity's biological evolution. The title alludes to this - 'What Technology Wants,' as if technology is a living, breathing thing.

Kelly's book is a must read for technologists and anybody interested in the future of the Web. In this post I'll explore a few of the main themes of the book, in particular as they relate to the evolving Web. (there won't be any spoilers, for those of you in the middle of reading it or if you haven't yet read it!) Two of the main themes are how technology will evolve and how we - humanity - can guide it and make the best use of it.

The book literally starts from The Big Bang, proceeds through 4 billion years of our planet's evolution, and finally looks ahead to how technology will evolve.

The Technium: a Living System of Technology

Key to the book is a new term that Kelly invents: the technium. He spends about 6 pages explaining the term, but at it's most basic it means a system of technologies. It includes not only what we ordinarily think of as specific technologies (such as cars, radar, computers), but the entire system around technology - culture, art, social institutions, "the extended human" and more.

A key to grokking the technium is that it's a living system, which evolves in a similar way to humans. On page 45, Kelly explains that "the technium can really only be understood as a type of evolutionary life." He goes on to suggest that technology evolves in a mix of inevitable and chance ways, just as humans have done. His point being that we can fairly accurately predict the macro evolution of the technium (that computers will eventually acquire a level of intelligence akin to a human, for example), but not the micro details of that evolution.

We've been writing about the Internet of Things, when real world objects become connected to the Internet, for the past couple of years on ReadWriteWeb. Kelly's book reinforces what a profound change in the Web this is. As everyday objects get connected to the Internet, they almost become 'alive' to us. They might not be able to think for themselves, yet, but billions of 'things' in the world will be able to sense and compute information about the world.

Living With Technology's Increasing Power

On page 254, Kelly writes that "technologies are nearly living things." So we will need to adjust to this and figure out how best to utilize - and live with - technologies. Kelly lists five "proactions" that humanity should take to assess and engage with technologies:

  1. Anticipation
  2. Continual Assessment
  3. Prioritization of Risks, Including Natural Ones
  4. Rapid Correction of Harm
  5. Not Prohibition but Redirection

At one point he compares technologies to children. As parents we aim to guide our children to reach their potential and contribute something to the world. "We can't really change the nature of our children," Kelly writes on page 257, "but we can steer them to tasks and duties that match their talents." Likewise, he suggests, we can guide and steer technology.

Was The Unibomber Right?

Kelly spends a significant part of the book exploring the moral and ethical issues around an ever more powerful technium. Is it wise for humanity to continue to let technologies evolve, until the technium is more intelligent than humanity?

A whole chapter is devoted to the theories of the infamous Unibomber, Ted Kaczynski. Kaczynski wrote a manifesto about destroying modern technology before it destroys us. He killed 3 people with mail bombs, while attempting to carry out his manifesto. Kelly at first defends Kaczynski's theories, but he ends the chapter by attacking him on a moral level. Kelly writes (page 212-213):

"But despite the reality of technology's faults, the Unibomber is wrong to want to exterminate it, for many reasons, not the least of which is that the machine of civilization offers us more actual freedoms than the alternative [...] so far the gains from this ever-enlarging technium outweigh the alternative of no machine at all."

The Optimistic View of Technology

Ultimately 'What technology Wants' is an uplifting and optimistic book about the future of technology. It contrasts in many ways to another thought-provoking technology book, which I read and reviewed a year ago: You Are Not a Gadget: A Manifesto; by Jaron Lanier. In that book, Lanier argued that technology reduces our humanity - for example by promoting the 'hive mind' over individual expression. Interestingly, Lanier is quoted on the jacket of Kelly's book. He recommends you read this book, "even though I profoundly disagree with aspects of it."

It's always beneficial to have skeptics about technology, so there's a place for Lanier's arguments. Both of Lanier's and Kelly's books are stimulating and well worth reading. However, I find myself much more swayed by Kelly's theories. Whereas Lanier dismisses the Internet as meaningless in and of itself, Kelly essentially argues that the technium (of which the Internet is a part) is a hugely important evolving system. It's as much a living system as humanity is. That, I suspect, is one of the aspects that Lanier would disagree with. But I find Kelly's theory to be compelling - and helpful as an approach to the increasing power of technology.

The book concludes that technology is ultimately good for humanity. Admittedly that was Kelly's pre-destined outcome - back in November, 2004, when he began writing the book, he blogged: "I sense that overall, technology is a good thing." However the end result of his 7 year quest, the book, compellingly makes that case. I think this line near the end of the book sums it up beautifully:

"How can technology make a person better? Only in this way: by providing each person with chances."

(which incidentally echoes my own thoughts after I read Lanier's book: "[...] Lanier glosses over the benefits of web 2.0 - that it gives everyone who has a computer (and nowadays a smart phone) a publishing platform with which to explore their creativity and have their say.")

I gave Kelly's book 5 out of 5 stars on Goodreads, because ultimately it provides useful advice on how to think about and deal with technology. Perhaps aspects of the book can be challenged on scientific or philosophical terms, as some have argued. But that seems beside the point. I think we'd all agree that technology is evolving incredibly fast. We need to try and understand the changes. We need strategies to get the best out of technology (and, by extension, ourselves). That's what Kevin Kelly wants; and in my view the book achieves it.
